Terms of Service

Effective date: February 16, 2026

CadenHQ is operated by Jeva Technologies OPC ("we", "our", "us"). By accessing or using CadenHQ (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not access or use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Service. By using CadenHQ, you represent and warrant that you meet these requirements.

2. Account Responsibility

  • You are responsible for maintaining the security of your account and credentials.
  • You are responsible for all activity conducted under your account.
  • You must notify us immediately of any unauthorized use at support@cadenhq.com.
  • We are not liable for any loss or damage arising from your failure to protect your account credentials.

3. Use of Service

You agree to use CadenHQ in compliance with all applicable laws and regulations, including data protection, privacy, and anti-spam laws.

You are solely responsible for:

  • The recipients of your emails and the accuracy of contact data
  • The content of your communications
  • Ensuring you have a lawful basis to contact recipients under applicable law
  • Complying with CAN-SPAM, GDPR, and any other applicable regulations in your jurisdiction

We do not initiate, review, or control emails sent through your connected mailbox. You are the sender of record for all communications.

4. Acceptable Use

You may not use CadenHQ for:

  • Illegal, fraudulent, or deceptive activities
  • Sending unsolicited or unlawful communications in violation of applicable anti-spam laws (including CAN-SPAM, GDPR, or similar regulations)
  • Phishing, harassment, or abusive messaging
  • Attempting unauthorized access to systems or data
  • Sending malware, viruses, or any harmful code
  • Impersonating any person or entity

We reserve the right to suspend or terminate accounts engaged in harmful, abusive, or unlawful conduct without prior notice.

5. Connected Email Accounts & Google OAuth

CadenHQ allows you to connect external email accounts, including Gmail, via OAuth. By connecting your email account, you authorize CadenHQ to:

  • Send emails on your behalf through your connected mailbox
  • Access reply emails within threads initiated through CadenHQ to detect responses and stop follow-up sequences

We access only emails within threads initiated by CadenHQ. We do not access, read, or store unrelated mailbox content.

Gmail data accessed through Google APIs is used solely to operate the Service on your behalf. We do not use Google user data to develop, improve, or train machine learning models, for advertising purposes, or for any purpose beyond operating CadenHQ's core features as described in our Privacy Policy.

You may revoke Gmail access at any time via your Google Account settings or by disconnecting your mailbox within CadenHQ. Upon disconnection, we immediately stop accessing your mailbox and delete all associated OAuth tokens. CadenHQ's use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements.

6. Credits and Billing

CadenHQ operates on a prepaid credit system. Credits are consumed based on usage of the Service.

Credits do not expire while your account remains active. Credits have no monetary value outside the platform and cannot be exchanged for cash.

Refund Policy

Credit purchases are generally non-refundable. Credits that have been used to send emails or access platform features are non-refundable.

Unused credits may be eligible for a refund within 7 days of purchase, at our discretion and in accordance with applicable law. To request a refund, contact support@cadenhq.com.

7. Payments

Payments are processed securely through third-party providers, including PayPal. We do not store full payment card information.

You authorize us to charge your selected payment method for purchases made through the Service. All prices are listed in USD unless otherwise stated.

8. Automation Features

CadenHQ provides automated features including campaign sequencing and reply detection. You are responsible for reviewing all content, templates, and campaign settings before activation.

We do not guarantee the accuracy, completeness, or suitability of any automated outputs. Automated features are provided as-is and may not perform as expected in all scenarios.

9. Data and Privacy

Your use of CadenHQ is governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of your data. We process data only as necessary to operate the Service.

We do not use your data, including any data accessed via Google APIs, to develop or improve generalized machine learning or AI models, or for any purpose unrelated to providing the Service to you.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Jeva Technologies OPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities.

Our total aggregate liability shall not exceed the amount you paid to us in the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Jeva Technologies OPC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content or communications sent through your connected email account.

13. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We may update, suspend, or discontinue features at any time with or without notice.

14. Termination

We may suspend or terminate your access to the Service for violations of these Terms, harmful activity, or for any other reason at our discretion, with or without prior notice.

You may discontinue use of the Service at any time by contacting support@cadenhq.com to request account deletion. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

15. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.
